Recruitment Campaign Terms of Service

JamesValé Recruitment is an Australian owned and registered company engaged in providing permanent staffing and recruitment solutions to employers nationwide. By requesting an invoice, making payment, providing either verbal or written approval to proceed, providing JamesValé Recruitment with vacancy information or by viewing a resume that has been presented by JamesValé Recruitment, the Client agrees to these Terms. The following Terms of Service apply to the entire agreement and no variation or alteration to these Terms will be valid by the Client. JamesValé Recruitment reserves the right to change or amend the Terms of Business at any time during your recruitment campaign.

Authority to Act

Once a candidate has been submitted to your company, that candidate has provided authorisation to JamesValé Recruitment to act as an agent on their behalf and present their details to you. All communication with the submitted candidate will be through JamesValé Recruitment, unless otherwise agreed. Should the candidate be employed by your organisation, affiliate, related or subsidiary company within this period, you will be required to inform JamesValé Recruitment of the candidate offer of employment.

JamesValé Recruitment has been authorised by the candidate to submit all relevant documentation and their details and makes no representations as to the accuracy of the information contained herein or in the submission of the candidate’s profile or resume. JamesValé Recruitment, its associates and/ or agents shall not be liable for any loss, damage, costs, claims, liability, or expenses suffered or incurred arising from or connected with, the recruitment or employment of any candidate referred by JamesValé Recruitment. The decision to offer and hire a candidate is solely that of the Client.

Using our Service

If you contact us or send vacancy information, we will contact you to discuss your role in more detail and accept your listing, or to inform you if we are not able to accept the listing for any reason. Once we have received payment via credit card or by the transfer of funds, we will commence the Recruitment Campaign.

The Recruitment Campaign

Once payment is confirmed, we will commence the Recruitment Campaign. The Recruitment Campaign runs for thirty (30) days, sending candidate resumes that are pre-qualified and available to interview. JamesValé Recruitment will work on your listing for thirty (30) days commencing on the date of payment, ending thirty (30) days later. JamesValé Recruitment does not offer full refunds for the Recruitment Campaign under any circumstances. JamesValé Recruitment under the Recruitment Campaign does not guarantee a candidate placement within your company beyond sixty (60) days from the date of payment. 

The Recruitment Campaign involves the sourcing, screening, shortlisting, providing a summary of the candidate’s experience and reference checking of candidates within thirty (30) days; writing your advertisement, advertising, and posting your job across 16 job boards (including Seek and Indeed), creating a video advertisement, posting on social media, engaging with experienced candidates to apply for your position, taking all inbound enquiries and notifying unsuccessful candidates. All fees that are quoted are exclusive of GST. 

Payment

Payment is upfront for a single recruitment vacancy and seven (7) days for contract or volume recruitment. Volume Recruitment are considered where two or more Recruitment Campaigns are requested at the same time. Payment is accepted via Credit Card or Electronic Funds Transfer. For any invoices unpaid after the due date, JamesValé Recruitment has the discretion to pass the account to a legal firm or Third-Party debt collection service and the Client will be liable for all costs incurred by JamesValé Recruitment in the collection of that debt. JamesValé Recruitment reserves the rights to charge interest on any overdue accounts not paid within seven (7) days.

Recruitment Campaign Fees

  1. Recruitment Campaign fees* are an upfront payment and are for;

    1. (a)  the sourcing, screening, shortlisting, providing a summary of the candidate’s experience and reference checking of interviewed candidates.

    2. (b)  writing your advertisement, advertising, and posting your job across 16 job boards (including Seek and Indeed), creating a video advertisement, posting on social media, engaging with experienced candidates to apply for your position, taking all inbound enquiries and notifying unsuccessful candidates.

    3. (c)  All fees that are quoted are exclusive of GST.

  2. JamesValé Recruitment is not responsible for establishing interviews for Clients. 

  3. JamesValé Recruitment is not responsible for the selection of any candidate by the Client; JamesValé Recruitment is not responsible for any acts, errors or omissions, wilful negligence or otherwise committed, by submitted or successful candidates.

  4. It is the responsibility of the Client to inform JamesValé Recruitment of any additional hires that is made from the Recruitment Campaign. This is to inform unsuccessful candidates of their application status.

  5. If any second and subsequent hire is appointed to a position within your company on a part-time, job trial, work experience, contract or temporary employment basis, the Client is responsible to inform JamesValé Recruitment, its associates and/ or agents.

  6. If possible, unlimited hires may be made under the Recruitment Campaign.

Hire Guarantee

The Hire Guarantee can be used in accordance with a completed thirty (30) days Recruitment Campaign. If you're unable to make a hire for your business, we will either continue the campaign for an additional thirty (30) days at no charge or refund $1,500 +GST into your nominated bank account.

6 Month Replacement Guarantee

The 6 Month Replacement Guarantee is optional and is only available for purchase, prior to commencement and a candidate’s employment, with you the Client/ Employer.
 

(a)  If the candidate’s employment ceases within one hundred and eighty (180) days after their commencement date, JamesValé Recruitment will provide the Client with a replacement Recruitment Campaign.

(b)  The Client will be entitled to one Recruitment Campaign only, as per payment, and under the (a) 6 Month Replacement Guarantee. The Recruitment Campaign under the (a) 6 Month Replacement Guarantee must be identical to the original position recruited for by JamesValé Recruitment.

(c) This guarantee is only valid if the cessation of employment is not due to restructuring of the position, redundancy or redeployment initiated by the Client and does not extend to cases of disability, injury or pregnancy.

(d) This guarantee is only valid for six (6) months or one hundred and eighty day (180) from the commencement date of employment.

*All fees are exclusive of GST.

Listing Agreement

We reserve the right to void any Guarantee if you:

  1. Do not respond to requests for information on the recruitment progress that would allow us to adjust your campaign.

  2. Are unwilling to accept instructions from our recruitment staff on changes that would assist in making a hire.

  3. Prevent us in any way from filling your listing or hindering our progress in working on your campaign or if you request that we do not work on your campaign at any time.

  4. Have not paid in accordance with our terms.

 

Job Offer and Acceptance

After written acceptance by the candidate, a formal letter and employment contract of offer should be produced by your company as per Fair Work Australia guidelines.
